The Argentinian Civil Code states that the surviving spouse has the right to remain in the house where he/she was living at the time of the testator’s death, thereby avoiding the division of the property. The cohabiting partner has a similar, but more limited, right. However, this possibility is not expressly accepted when the person seeking to remain in the property is the deceased’s underage heir. This lack of recognition generates a tension between the civil law rules concerning hereditary division and the special protection that must be assigned to children, especially after the approval of the Convention on the Rights of the Child. The purpose of this paper is to analyze a judgement where this tension was solved by extending to the child the right recognized to the surviving spouse. The aim is the evaluate the arguments offered by the judge, as well as to present some additional ones in favor of the decision.El Código Civil y Comercial argentino reconoce al cónyuge supérstite la posibilidad de requerir el derecho real de habitación, impidiendo con ello la partición del inmueble en el que residía al momento de la muerte del causante. Un derecho similar, aunque más limitado, se reconoce al conviviente. Sin embargo, esta misma posibilidad no se encuentra receptada cuando quien procura permanecer en el inmueble es el heredero menor de edad del causante, generando una tensión entre las disposiciones civiles sobre partición hereditaria y la especial protección que se debe asignar a los niños, especialmente luego de la ratificación de la Convención de los Derechos del Niño. En el presente trabajo se comenta la sentencia de un tribunal argentino en la que se ha intentado resolver esta tensión, extendiendo a los niños el derecho real de habitación que solo se encuentra reconocido expresamente para el cónyuge. El objetivo es analizar la pertinencia de los argumentos esgrimidos, así como ofrecer algunos argumentos adicionales en favor de la decisión.
