Metaverse, gender-based violence and virtual restraining order

The metaverse, as a three-dimensional and interconnected digital space, presents significant legal challenges that require a reflection on the possible adaptation of the legal framework to maintain a balance between technological innovation and user safety. This article explores the extrapolation of restraining orders to the metaverse, a virtual environment where the spatiotemporal structure is diluted, and the creation of multiple identities is facilitated through Artificial Intelligence. In the context of violence against women, a phenomenon that evolves and utilizes technological developments to exert control, effective regulatory proposals necessitate a deep understanding of the dynamics of the metaverse, its potential, and its limitations. This understanding is crucial to anticipate future scenarios that allow for reconsideration of judicial responses to these new situations within the Chilean and Spanish legal systems.
